THE A76 TRUNK ROAD (NEW CUMNOCK STATION WALL EAST REPLACEMENT) COMPULSORY PURCHASE ORDER 201
Notice is hereby given that the Scottish Ministers, in exercise of the powers conferred by the above mentioned Acts, on the 12 July 2018 prepared a Compulsory Purchase Order entitled "The A76 Trunk Road (New Cumnock Station Wall East Replacement) Compulsory Purchase Order 201" which affects the land described in the Schedule hereto for the purpose of improving a length of the A76 Dumfries -Kilmarnock Trunk Road in the vicinity of New Cumnock, East Ayrshire by replacing the New Cumnock Station Wall East. The Order is about to be made and comes into operation only if made. If the Order is made, a conveyance registered in implement of the Order may vary or extinguish rights to enforce real burdens and servitudes affecting the land. Copies of the Order and of the map referred to therein have been deposited at the following offices and may be seen there without payment of fee during normal business hours from 19 July 2018 until 16 August 2018:-Transport Scotland, Reception, 5th Floor, Buchanan House, 58 Port Dundas Road, Glasgow G4 0HF; Council Headquarters, London Road, Kilmarnock, East Ayrshire, KA3 7BU and Cumnock Community Library, 1 Greenholm Rd, Cumnock KA18 1LH. Any person may object to the making of the Order, by notice in writing, to the Director of Trunk Road and Bus Operations, c/o Anthony Friel at Transport Scotland, Buchanan House, 58 Port Dundas Road, Glasgow, G4 0HF quoting reference SW/A76/NEW CUMNOCK/CPO and stating the grounds of objection. Any objections must be received on or before 16 August 2018. 2135 square metres or thereby of land directly North of an access to Waterside Industrial Estate to a point on the A76 directly South of the existing railway bridge parapet consisting of the solum of the Trunk Road and embankment and land lying directly east of the trunk road.

ENVIRONMENTAL IMPACT ASSESSMENT DETERMINATION BY THE SCOTTISH MINISTERS UNDER SECTIONS 20A AND 55A OF THE ROADS (SCOTLAND) ACT 1984
The Scottish Ministers hereby give notice that they have determined that their proposal to replace the New Cumnock Station East Wall on the A76 trunk road is-
(a) not a project which falls within Annex I of Council Directive No. 85/337/EEC on the assessment of the effects of certain public and private projects on the environment as amended by Council Directive No. 97/11/EC and Council Directive No. 2003/35/EC of the European Parliament and Council;
(b) is a relevant project within the meaning of Sections 20A(9) and 55A(7) of the Roads (Scotland) Act 1984, and falls within Annex II of the said Directive but that having regard to the selection criteria contained in Annex III of the Directive it should not be made subject to an environmental impact assessment in accordance with the Directive, and accordingly the project does not require the publication of an Environmental Statement.
