A TEENAGER who threw a traffic cone at a stranger before stealing an officer’s baton has avoided being sent to prison.

Andrew Middlemas, 18, appeared in Glasgow Sheriff Court after previously pleading guilty to assault on August 29 last year.

The court heard: “At 10.30pm, the witness was within his home in North Kelvinside when he heard a disturbance and went outside. The accused began to move off but then returned with a traffic cone.

"He threw this at the witness and then punched him on the face, causing bruising and his mouth to bleed. Police attended and an officer reached to draw his baton.

“As the baton was drawn, the accused lunged forward towards him and knocked him back slightly. The accused grabbed the baton.

"A struggle then ensued and the accused was taken to the ground. He kicked a female officer to her legs and abdomen and kicked the other officer to the right side of his body.

“He failed to desist but after several warnings, he released the baton.”

Middlemas, of Scotstoun, was conveyed to Govan police station.

His lawyer said a verbal disagreement took place between his client and the witness earlier in the evening, but that was no excuse for the “totally unacceptable conduct”.

The defence solicitor added: “He regrets his involvement.

“He realises that he could be looking at a period of detention. Although, an alternative disposal is available.”

Sheriff Paul Brown told the teenager: “I’m sure there are a lot of people very disappointed, including yourself.

“A lot of investment has gone into you and you clearly have a lot of ability. I’m happy to hear you are addressing your alcohol use and I hope you continue to do that. if that’s what’s leading you into this behaviour.

“I’m looking for you to put all of this behind you. I’m going to give you a chance to do that. I will place you on a structured deferred sentence.”

A review will be held in August.
