A SUSPECTED drink driver refused to carry out breath tests after he was caught driving to the shops.
Lee Hynd attempted to evade police officers whilst behind the wheel of his dad’s car.
The 31-year-old also tried to run away after getting out of the vehicle at around 9.30pm on March 21.
Glasgow Sheriff Court heard that police received an anonymous report of a man drink driving in Summerston.
The prosecutor said: “The officers’ attention was drawn to the accused’s vehicle travelling at a high speed on Invershiel Road.
“The car turned and due to the speed, was in the opposing lane. Police followed the vehicle and activated their emergency lights.
“The accused’s vehicle began to accelerate rapidly, straddling both lanes at 50mph within a 30mph zone, as it travelled around a sweeping bend.
“The car turned left at the next junction and again, due to the high speed, utilised the opposing lane. The car thereafter continued straddling both lanes in excess of the speed limit.
“The vehicle then swerved into Blackhill Court where it stopped.
“The accused exited the driver’s seat and ran towards Blackhill Road. Police continued on foot and detained the accused.”
As cops informed Hynd he was under arrest, he began to struggle violently with them, lashing out with his arms and legs.
The court heard that officers said he was heavily under the influence of alcohol or drugs.
Whilst within Clydebank police office, Hynd refused to provide two specimens of breath, stating “I have the right to remain silent”.
Hynd appeared for sentencing at the court on Thursday after previously pleading guilty to dangerous driving, struggling with police officers in an attempt to resist arrest and failing to provide breath specimens.
Hynd’s defence solicitor said: “He had been in his own house and decided to go down to one of the local shops. The car is his father’s.
“He accepts responsibility and the fact he’s put himself in a difficult position. It’s been three years since he last offended.”
Sheriff Mary Shields ordered Hynd, of Summerston, to carry out 120 hours of unpaid work.
He was also disqualified from driving for 19 months and will have to resit the driving test.
