A tenant who has waited ten years to be moved from a flat with mould said he was given an “ultimatum” to sign a legal disclaimer to be prioritised for a move.

The Glasgow Times reported how Alex Gordon, 66, who is severely ill with mould allergies and breathing conditions, has been trying to be moved out of the flat, in the south of the city, since 2013.

Mr Gordon, who is from Azerbaijan and who has residency in the UK, has a copy of a document he said he was “pressured” into signing last year to absolve Wheatley Homes Glasgow (formerly GHA) of any legal or financial liability.

He has copies of several letters from his GP, a consultant respiratory physician and an architecture expert stating the flat was contributing to his health issues and he should be moved urgently.

We reported Prof Malcolm Shepherd, a respiratory consultant, stated in 2019 Mr Gordon’s condition was “indicative of persistent and chronic exposure of his upper airways to mould”.

Previously Wheatley said it carried out inspections and found “some small areas of minimal damp and mould” and has been unable to access the property to make repairs.

It also said: “The tenant has been considered a top priority for a move with us since July last year for a top-floor flat in Mansewood.”

The landlord said he has been made an offer of another property and it is awaiting a response.

The document, from July 2022, seen by the Glasgow Times, states that he “agrees to Wheatley Homes Glasgow remaining entirely free of all liability relating to any medical issues allegedly resulting from the alleged mould and dampness at (his address).

“By agreeing to sign this document you agree to Wheatley Homes Glasgow remaining entirely free of all liability, including fiscal responsibility for any medical or mental injury during your residence within the property.”

The document concludes with what Mr Gordon said was an “ultimatum”.

It states: “By signing below you agree to forfeit all legal action against Wheatley Homes Glasgow.

“In return, you will be placed in a prioritised banding and receive supporting in being rehoused in a third-floor tenement flat.”

Wheatley Homes Glasgow said that staff were in contact with Mr Gordon for two weeks to discuss and answer any concerns he had.

Mr Gordon was previously placed in band F which is no housing need, and the social landlord said the flat was inspected and there was no evidence of damp or mould.

However, the tenant said that the housing association had attempted repairs and spent £10,500 on remedial measures that he said did not work.”

Mr Gordon, said: “GHA pressurised me to sign saying this is the only way to be moved.”

He added: “I was always in Band F but they said they would put me in Band A and I would get moved if I would sign.

“It was an ultimatum. GHA inspected the house three times and said there was no mould then I get a letter saying sign and I will get a move.

“If I didn’t sign, I would stay in band F and be staying in this house.”

A Wheatley Homes Glasgow spokesperson said: “We’re very sorry to hear about the tenant’s concerns.

“Our staff were in regular contact with the tenant for two weeks to answer any questions he had about the letter. We also brought in an interpreter to make sure everything was clear.

“We’ve tried more than 10 times in the last year to get access into the home and carry out repairs. The tenant has refused each time.

“The tenant has been clear he only wants a top floor flat in Mansewood or nearby areas. Unfortunately, we have a very low turnover of top floor flats in these communities.

“We made him an offer of a move three weeks ago, but we’ve yet to hear back from him.”
