BROTHERS accused of attacking their sibling and elderly mother at a family funeral have been cleared.

Gerald Burns, 59, and Hugh Burns, 63, were alleged to have assaulted Michael Burns, 56, and Margaret Burns, 92, at Daldowie Crematorium, South Lanarkshire, on May 23 2022.

The siblings and their mother attended their other brother John Burns' funeral that day amid a family dispute.

Court papers stated that Gerald and Hugh seized Margaret - who used a wheelchair - on the body to her injury.

Co-accused brother James Burns, 64, was claimed to have assaulted Michael by kicking him on the body to his injury at the same time and place.

James faced a separate charge of behaving in a threatening or abusive manner.

It was claimed he repeatedly adopted an aggressive demeanour and uttered homophobic remarks.

Gerald and Hugh were also accused of behaving in a threatening or abusive manner.

They were claimed to have repeatedly shouted, swore and adopted an aggressive demeanour as well as uttered threats of violence.

Gerald and James, both of Uddingston as well as Hugh of Viewpark, Lanarkshire, had denied the charges against them.

Sheriff Allan McKay found the trio not guilty of the charges.
