A man was shot in the face in a murder bid in the car park of a vet, a trial heard. 

Scott Bennett was allegedly assaulted by Barry Harvey, 35, Thomas Guthrie, 27, and Darren Owen, 23, in Rutherglen on December 3, 2018.

Court papers state they discharged a firearm and shot him in his head at Taylor Veterinary Surgery.

The trio are stated to have set a car on fire said to have been used in the offence in an attempt to defeat the ends of justice.

A joint minute of agreed evidence was heard by the jury on Monday at the High Court in Glasgow.

Crown junior Victoria Dow said that Mr Bennett was in a Peugeot hired van when he was shot.

She said: "Scott Bennett was shot in the head and he drove from the car park of the Taylor Veterinary Surgery to the Blue Rupee restaurant in Rutherglen where the emergency services were contacted.

"Scott Bennett was taken by ambulance to the Queen Elizabeth University Hospital.

"He was found to have sustained a single gunshot wound to the left side of his face.

"The bullet entered his jaw, passed through his teeth and tongue, and lodged in his neck."

Miss Dow stated that the bullet cut Mr Bennett's tongue and his injuries required stitches.

She said: "The jaw fractures were consistent with a bullet entering his jaw.

"In an operation, his fractures were repaired with two titanium plates and eight titanium screws.

"The bullet remains in situ because of the risk of permanent injury."

The crown junior said that the cartridge used was manufactured in the Czech Republic for an Austrian-manufactured self-loading pistol.

The joint minute further stated that a silver BMW was stolen from the Newton Mearns area on October 10 or 11, 2018.

It was stated that the BMW was "wilfully set on fire" and found in Glasgow's Battlefield on the same day as the shooting.

Miss Dow told jurors that Guthrie was employed at the time as a labourer by JM Contracts.

She said that Guthrie did not attend work on December 3 or December 4 2018 which was not "pre-planned" or a "reported absence."

The crown junior stated that on December 18, 2021, a driving licence was issued to Harvey's brother James.

Miss Dow told jurors that the picture on the licence was of Barry Harvey.

She added that a passport application for James Harvey which contained a picture of Barry Harvey was refused on March 17, 2021.

Harvey, 35 and Thomas Guthrie, 27, are accused of a murder bid on lawyer Joseph Shields on July 19 2018.

The charge says this was done by repeatedly striking Mr Shields on the head and body with a knife.

Harvie and Guthrie face a separate charge of attempting to pervert the course of justice by setting fire to a vehicle used in the commission of the alleged attempted murder in Baldernock, East Dunbartonshire.

Another charge states Harvey, while acting with Guthrie and a Neil Anderson, murdered Gary More at a property in Airdrie, Lanarkshire, on September 6 2018.

Harvey while acting with Guthrie are claimed to have set fire to the vehicle used in the alleged crime near a farm in Milngavie, East Dunbartonshire, in an attempt to pervert the course of justice on the same day.

The pair and Darren Owen face a separate murder bid charge on Scott Bennett by discharging a firearm and shooting his head in a car park at a vet's in Rutherglen, Lanarkshire on December 3, 2018.

The trio are stated to have set a car on fire said to have been used in the offence in an attempt to defeat the ends of justice.

Owen and Wilson are alleged to have murdered Rafal Lyko on February 11, 2019, in Cambuslang and Blantyre, Lanarkshire on February 2019.

Harvey is further accused of assaulting Guthrie by striking him on the head with a bottle and the body with a hammer to his injury.

The trial continues before Judge Lord Clark.
