A PERVERT who recorded himself performing a sex act on his friend while she slept avoided jail today.

David Ellingham, 28, carried out the sick deed on the woman at a property in Glasgow's Govan between May 2021 and April 2022.

The city's Sheriff Court heard Ellingham had initially been babysitting for the woman who went on a night out.

The woman returned in the early hours of the morning and fell asleep next to Ellingham.

She woke up a few hours later and noticed that her feet were wet.

Ellingham, of Kilsyth, was also awake at this time.

Prosecutor Ryan Watson said: "She asked why her feet were wet and Ellingham said that he spilled juice on the bed.

"She noted that the bed was dry, however, Ellingham said that the sheets must have dried in."

The woman also noticed that Ellingham's torch on his phone was on.

Ellingham then left the room which the woman thought was suspicious.

She asked what he was doing which made Ellingham become defensive but she did not pursue it further.

The pair were together in April 2022 when the woman asked to borrow Ellingham's phone to play a game on it.

Ellingham fell asleep and the woman then accessed his phone's photo gallery.

Mr Watson said: "She noticed pictures of feet and thereafter found a video of Ellingham performing a sex act on her which she did not consent to."

The woman recorded the video on her own phone before deleting the original from Ellingham's.

She contacted a friend to pick her up before she contacted the police.

Ellingham was later arrested when he told officers: "I didn't have any images on my phone."

Ellingham pleaded guilty in January to sexually assaulting the woman.

Sheriff Barry Divers tagged Ellingham today for 216 days keeping him indoors between 7pm and 7am.

He was also put under supervision for 12 months and placed on the sex offenders register for five years.
